When Is the Best Time to Start My Application with BDV Solutions?
Key Question: Can You Afford the Costs?
Before you start, ask yourself the most important question: Do I have the ability to afford the costs of the process?
If the answer is yes, let's move to the next few questions.
Are You Doing Consular Processing or Adjustment of Status?
The timing of your application depends on whether you are applying through:
- Consular Processing (outside the United States)
- Adjustment of Status (inside the United States)
Adjustment of Status (Inside the United States)
If you are adjusting your status in the United States, it’s important to start the process as soon as possible because you must maintain your status until you get your:
- I-140 approved
- EAD card in hand
If You Are on OPT
Do not wait to start your process.
- Your OPT will eventually expire, and if you don’t reach the EAD approval step of the EB-3 process by expiration, you may need to get a new I-20 to maintain your status.
If You Have One Year Remaining Before Graduation
This is another good time to apply.
- If all goes well, you may not need to apply for OPT because you could already have your EAD through the EB-3 process.
If You Are About to Graduate
You should still apply—but be prepared to maintain your status after graduation.
- Most of our clients do this via:
- Post-completion OPT
- Getting a new I-20 and starting another program
If You Recently Entered the US
You are still eligible to apply!
- You must have been physically present in the US for at least 90 days for us to accept your application.
Anytime While in Status
You can apply at any time as long as you are in status.
Consular Processing (Outside the United States)
If you are consular processing outside the United States, there is no rush to get started.
Start your process once you are financially and mentally ready to do so.
