Department of Labor information:

As of January 2025, the National Prevailing Wage Center (NPWC) is processing Prevailing Wage Determinations (PWDs) filed in June 2024 for both OES and non-OES wages, including private wage surveys. Redetermination requests submitted in June 2024 are also under review. Based on current trends, PWDs are typically being issued within six months.

Updated processing times

For PERM applications, the Department of Labor (DOL) is currently processing cases filed in September 2023, with an average adjudication time of 462 days if no audit is issued. While this month’s update does not include specific timelines for audited cases, the DOL previously reported that audits were being processed for applications filed in December 2022, with an average total processing time of 496 days.

PERM reconsideration requests submitted in July 2024 are now under review. On average, we are seeing PERM approvals within 14 to 15 months for cases that do not undergo an audit, which is consistent with the DOL’s reported trends.

With ongoing backlogs and fluctuating timelines, it remains essential to plan ahead and stay updated on processing trends to navigate the PERM process effectively.

USCIS Updates Filing Procedures for Form I-140

USCIS announced updated procedures for filing Form I-140 with a permanent labor certification, Schedule A designation, or national interest waiver (NIW) request. Since June 1, 2023, the DOL's new FLAG system requires the revised Form ETA-9089, which collects detailed job and worker information. Employers approved through FLAG receive a 2-page Final Determination electronically. When submitting Form I-140, only the signed Final Determination is required, as USCIS now receives most labor certification data directly from DOL via a data-sharing agreement.
