USCIS announced in April 2024 a temporary final rule (TFR) to increase the automatic extension period for certain employment authorization documents (EADs) from up to 180 days to up to 540 days, as long as an EAD renewal application is filed prior to EAD expiration.This applies to certain EAD categories, including FNs with pending Adjustment of Status applications (Category C09).This update, along with the increase in the maximum validity period to 5 years for initial and renewal Employment Authorization Documents (EADs) for certain categories, including FNs with pending Adjustment of Status applications (Category C09), helps to ensure FNs can continue to work while USCIS adjudicates their EAD renewal and minimizes the number of EAD renewals that a FN needs to file.
“We have been working with Congress to encourage the Department of Labor to speed up PERM processing using the (digital) processing technology they already have vs. routinely requesting additional funding "for improvements" without actually yielding major improvements. Recently, the Committee released a report with instructions for the DOL to use their current resources to shorten PERM processing times. It also requires the DOL to report back within 60 days on their efforts to improve these timelines.
Along with that, we are meeting with the White House again on August 15 to discuss DOL processing. The White House will invite Senior DOL leaders to this meeting. Our plan is to outline our proposals and highlight how PERM processing improvements have bipartisan and bicameral support.”
